Terms of Use

Effective date: 2022

These Terms of Use govern your access to and use of vividmotion.co (the "Site"), operated by Vivid Motion Media LLC ("Vivid Motion," "we," "us"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

These terms cover use of the Site only. Any project we carry out for a client is governed by a separate signed agreement, which takes precedence over these terms for that work.

You may use the Site for lawful purposes and for learning about our work and services. You agree not to:

  • use the Site in any way that breaks the law or infringes the rights of others;
  • attempt to gain unauthorised access to the Site, its servers or any connected system;
  • interfere with or disrupt the Site, or introduce malicious code;
  • scrape, copy or harvest content from the Site at scale or for republication; or
  • use the Site to send unsolicited communications.

We may suspend or restrict access to the Site at any time without notice.

Intellectual property

The Site and its content, including text, design, graphics, layout, code, logos and the Vivid Motion name and marks, are owned by Vivid Motion or its licensors and are protected by intellectual property laws. The project work shown in our portfolio is presented to demonstrate our capabilities, and the rights in that work belong to Vivid Motion or to the respective clients.

You may view and share links to the Site, but you may not copy, reproduce, republish, modify or distribute any part of it without our prior written permission.

Journal content

Articles in our Journal are published for general information about design, technology and strategy. They reflect our views at the time of writing and are not professional advice for your specific situation. Any decision you make based on them is your own.

Third-party links

The Site may link to third-party websites or services we do not control. We provide those links for convenience and are not responsible for the content, policies or practices of any third-party site.

Disclaimers

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind about the Site, including its accuracy, reliability or availability, and we disclaim all implied warranties. We do not warrant that the Site will be uninterrupted or error free.

Limitation of liability

To the fullest extent permitted by law, Vivid Motion will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of or inability to use the Site. Nothing in these terms excludes any liability that cannot be excluded under applicable law.

Changes to these terms

We may update these terms from time to time. The current version is always the one posted on the Site, with the date shown above. Continued use of the Site after a change means you accept the updated terms.

Governing law
